Terms of Service

1. Acceptance of Terms

By texting JOIN to our business number, submitting a contact form, dispatching a job, or otherwise engaging with our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.

We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Services Provided

DFW Motor Club provides dispatch coordination services. We do not directly perform towing services. All towing is performed by independent operators who are not employees of DFW Motor Club. Our Service includes:

• SMS-based dispatch notifications to available drivers
• GPS tracking and monitoring during active jobs
• Before-and-after photo documentation
• Claim-ready PDF job reports
• Coordination and communication between parties

3. Driver Terms

3.1 Eligibility

To participate as a Driver, you must hold a valid commercial driver's license, maintain current commercial auto liability insurance, own or operate towing equipment in good working condition, and pass our qualification review.

3.2 Driver Obligations

As a Driver, you agree to respond to dispatch notifications timely, complete accepted jobs professionally, capture required photos on every job, maintain GPS tracking during jobs, and notify DFW Motor Club promptly of any incidents.

3.3 Payout Structure

Drivers receive 70% of the job total for each completed job. Payment is contingent on successful job completion with required documentation. DFW Motor Club reserves the right to adjust the payout rate with 30 days written notice.

3.4 Independent Contractor Status

Drivers are independent contractors, not employees of DFW Motor Club. You are solely responsible for your own taxes, insurance, equipment maintenance, and operating expenses. Nothing in these Terms creates an employment, partnership, or joint venture relationship.

4. Customer Terms

4.1 Service Requests

By requesting service, you agree to provide accurate information about the vehicle, location, and service needed.

4.2 Payment

Payment terms and rates will be established prior to service delivery. Disputed charges must be raised within 7 days of service completion.

4.3 Vehicle Condition

Customers are responsible for disclosing any known conditions of the vehicle that may affect towing. DFW Motor Club is not liable for damage resulting from undisclosed vehicle conditions.

5. Prohibited Conduct

• Providing false or misleading information in connection with any service request
• Using the Service for any unlawful purpose
• Harassing, threatening, or abusing any Driver, Customer, or DFW Motor Club personnel
• Circumventing the dispatch system to arrange direct payments outside the platform
• Attempting to gain unauthorized access to the Service or its systems
• Using the Service to transport stolen vehicles or in furtherance of illegal activity

6. Documentation and Data

GPS tracking data and photographs captured during service are the property of DFW Motor Club and may be used to resolve disputes and comply with legal requirements. By using the Service, you consent to the collection of GPS location data and photographs related to dispatched jobs.

7. Limitation of Liability

DFW Motor Club is a dispatch coordination service and is not liable for damage occurring during towing performed by independent Drivers.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DFW MOTOR CLUB'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE 30 DAYS PRECEDING THE CLAIM. IN NO EVENT SHALL DFW MOTOR CLUB BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

8. Indemnification

You agree to indemnify and hold harmless DFW Motor Club, its members, managers, and agents from any claims, liabilities, or expenses arising out of your use of the Service, your violation of these Terms, or your performance of towing services.

9. Dispute Resolution

Disputes shall first be addressed through direct communication. If informal resolution fails, disputes shall be resolved by binding arbitration in Dallas County, Texas. These Terms are governed by the laws of the State of Texas.

10. Termination

Either party may terminate participation at any time. DFW Motor Club reserves the right to suspend or terminate access immediately for violation of these Terms or conduct that poses a risk to safety or the network.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. DFW MOTOR CLUB DOES NOT WARRANT UNINTERRUPTED SERVICE OR GUARANTEED DRIVER AVAILABILITY.
